Belveo UK Ltd may have to adapt these terms and conditions when required by law and reserves the right to modify these terms and conditions at any time. Article 1 - Object

These general terms and conditions of sale govern distance selling on the website www.belveo.co.uk by Belveo Uk Ltd at Sovereign House, 212-224 Shaftesbury Avenue, London, WC2H 8HQ, of garden design products including parasols, shade sails, pergolas, and accessories.

By ordering any of the goods, you agree to be bound by these Terms and Conditions. You can only purchase the Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.

Article 2 - Price & Goods

Prices

The prices of our products are indicated in pounds (£) including all taxes (VAT and other taxes applicable on the day of the order) unless otherwise indicated and excluding processing and shipping costs.

Furthermore, in the event of an order to a country other than the United Kingdom you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Belveo Uk Ltd . They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to inquire about these aspects with your local authorities. 

All orders, whatever their origin, are payable in pounds (£).  

Belveo Uk Ltd reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability. 

The products remain the property of Belveo Uk Ltd until full payment is received.  

Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

 The description of the Goods is as set out in the website, catalogs, brochures, or another form of advertisement. Any description is for illustrative purposes only and there may be small dissimilarities in the size and color of the Goods supplied.

The contractual information is presented in English and will be confirmed at the latest at the time of validation of your order.  

Belveo Uk Ltd reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulties concerning the order received. 

Article 4 - Validation of your order

Any order placed on the website https://www.belveo.fr/fr/ implies acceptance of these General Conditions. Any confirmation of an order implies your full and complete acceptance of these general conditions of sale, without exception or reservation. All the data provided and the recorded confirmation will be considered as proof of the transaction. 

You declare that you are fully aware of this.  

Each step of the order process on the website allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly. 

The order confirmation will be considered as a signature and acceptance of the operations carried out.  

A summary of the information of your order and of the present General Conditions will be communicated to you via the e-mail address of your order confirmation. 

Article 5 - Payment

Validating your order implies for you the obligation to pay the price indicated.  

Payment of your purchases can be made by Credit card

The card is debited at the time of the order. The only accepted currency is the GBP.

Article 6 - Security of bank details

For each product offered for sale, the customer has the possibility of paying by credit card by indicating his 16-digit card number, his expiry date, and the visual cryptogram on the back of his card. The customer's bank may request authentication of the latter at the time of payment by credit card by any means agreed between the customer and his own bank (3D secure process - Verified by Visa and MasterCard Secure Code). The products ordered remain the property of Belveo Uk Ltd until the invoice has been paid in full. The customer certifies that he/she has the necessary authorization to make the payment by credit card.

The customer connects to the website https://www.belveo.co.uk  via the Internet by any means of communication at his disposal. Belveo Uk Ltd uses the encryption technology provided by HiPay to secure bank transactions in accordance with current legislation. Banking information is only transmitted to HiPay, is not stored by Belveo Uk Ltd, and is encrypted with SSL (Secure Socket Layer) 128 bits. The appearance of "https://..." in the address field and/or the "padlock" pictogram in the browser, during payment, are proof accepted by the customer.

Article 7 - Right of withdrawal and return of products

According to the Consumer Rights Act 201, you have 14 days from the date of receipt of your products to exercise your right of withdrawal without having to give any reason or pay any penalty.

You must notify us of your decision to withdraw from your order by a clear statement setting out your decision. You can submit your request by email contact@belveo.com. In any event, you must be able to show clear evidence of when the cancellation was made, so you may decide to use the model cancellation form. 

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

Please note: if you return incomplete, damaged, or spoiled items, you will be charged for the cost of restocking. Products that are too damaged by customers to be used cannot be returned.

Return your items by the carrier, at your expense, to the following address Guardian Warehousing Limited Noose Lane, Willenhall, West, Midlands, WV13 3AP. Please contact us if you would like us to help you find a carrier.  

Belveo Uk Ltd is obliged to reimburse the sums paid by the customer, with the exception of the return costs, which are to be paid by the customer. Thus, in the event of exercising the right of withdrawal, Belveo Uk Ltd will reimburse the sums paid, excluding return costs, within 14 days of notification of your request and via the same means of payment as used at the time of the order. 

Article 8- Availability

Our products are offered as long as they are visible on the https://www.belveo.co.uk  website and within the limits of available stocks. For products not in stock, our offers are valid subject to availability from our suppliers.

If a product is not available after you have placed your order, we will inform you by e-mail as soon as possible (within 8 days at the latest). In this case, we will propose either to cancel your order or to wait for the delivery by our supplier, specifying the delay. 

Article 9 - Delivery

Delivery is made to your home with or without an appointment by courier, express or specialized carrier, depending on the size of your packages.

The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.

In the event of a delay in shipment, an email will be sent to you to inform you of the possible consequences on the delivery time indicated to you.  

In accordance with the legal provisions, in the event of a delay in delivery, you have the possibility of canceling the order in accordance with the terms and conditions defined in articles L 138-2 of the Consumer Code. If in the meantime you receive the product, we will proceed to reimburse you and the delivery costs under the conditions of article L 138-3 of the Consumer Code. 

In the event of delivery by a carrier, Belveo UK Ltd cannot be held responsible for any delay in delivery due exclusively to the customer's unavailability after several proposed appointments. If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location we may charge the reasonable costs of storing and redelivering them. 

Belveo UK draws your attention to the following:

1) It is strongly advised to keep the packaging in case of return of the product.

2) The Goods will become your responsibility from the completion of delivery. Therefore, if the goods have been damaged during transport, the buyer must systematically make precise handwritten reservations on the delivery note about the nature of the problem. If no reservations are made on the delivery note, then the delivery will be deemed to be in conformity with the order and the customer will bear any prejudice linked to the anomalies and/or damage noted. In the event of a problem, we advise our customers to come forward within 48 hours of delivery, otherwise, no claim can be made to the carriers.

Beware: the mention "subject to unpacking" has no legal value. If the goods are too damaged, the buyer must refuse the parcel and contact the customer service to agree on a new shipment of the order, if the product is still in stock.

Article 10 - Warranty and after-sales service

We have a legal duty to supply the Goods in conformity with the Contract (be of satisfactory quality; conform to their description; be fit for any purpose held out by us or set out in the Contract). 

All our products benefit from the guarantee of conformity and the guarantee of hidden defects. In case of non-conformity of a product sold, it can be returned, exchanged, or refunded. We are offering you a 2 years warranty on your products.

All claims, requests for exchange or refund must be made by e-mail (contact@belveo.com) 

The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.). The shipping costs will be reimbursed on the basis of the invoiced rate and the return costs will be reimbursed on the presentation of the receipts.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 7.

Article 11 - Responsibility

The products offered to comply with the legislation in force. Belveo UK Ltd shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you are considering ordering. 

Furthermore, Belveo UK Ltd shall not be held responsible for any damage resulting from improper use of the product purchased. 

Finally, Belveo UK Ltd shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion, or the presence of computer viruses. 

Article 12 - Disputes and applicable law in case of disputes

Disputes

Belveo UK does not exclude liability for: 

any fraudulent act or omission; 

for death or personal injury caused by negligence or breach of the Supplier's other legal obligations. 

Belveo UK Ltd is not liable for 

loss which was not reasonably foreseeable to both parties at the time when the Contract was made, 

loss (eg loss of profit) to the Customer's business, trade, craft, or profession which would not be suffered by a Consumer - because the Supplier believes the Customer is not buying the Goods wholly or mainly for its business, trade, craft, or profession.

The applicable law in case of disputes

The Contract is governed by the law of England and Wales. In the event of a dispute, the English courts shall have exclusive jurisdiction. The seller reserves the right to choose the competent court.

Article 13 - Intellectual property

All elements of the https://www.belveo.co.uk website are and remain the exclusive intellectual property of Belveo UK Ltd. No one is allowed to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, the elements of the site whether software, visual, or sound. Any simple link or hypertext link is strictly prohibited without the express written consent of the Belveo UK Ltd.

Article 14 - Personal data

Belveo UK Ltd reserves the right to collect personal information about you. This information is necessary to manage your order and to improve the services and information we send you.  

It may also be transmitted to companies that contribute to this relationship, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.  

This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.  

You have the right to access, rectify and oppose any nominative information and personal data concerning you, directly on the website. For more information, please refer to the page Privacy Notice.

Article 15 - Archiving

Belveo UK Ltd will archive the order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of the Data Protection Act 2018.

The computerized records of the Belveo UK Ltd will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties. 

By purchasing a product or service from the Belveo UK e-commerce site, you acknowledge that you have read and accepted the general conditions of use.
